Do Mercenary effects apply when the Mercenary is not in the battle?

No. The rulebook says Mercenary abilities that work in battle can be used only if the Mercenary is participating in the battle. In space a Mercenary counts toward Fleet Supply, can reveal Space Domain counters, and (per a relayed FFG reply) can be hit by bombardment. Effects that apply to all units or ships also affect it.
