Do I have to Pass when I have no cards, and can I Pass with cards in hand?

Yes to both. Pass is an Action you must perform yourself (there is no automatic pass), it costs no Action card, and you can take it first or second even with a full hand. When you Pass you may discard any cards, and your turn ends.
