Can the Psychic be used when the draw pile is empty or when I do not draw?

Yes. You can use its peek whether or not you end up drawing. If the draw pile is empty, the rulebook has you reshuffle the discards into a new one. The rulebook also says you cannot draw train cards when 8 or fewer cards remain in deck and discard combined, and no ruling says whether the Psychic still works then.
