The designer ruled that without a bid you don't get the art, and the rulebook gives the tiebreak.

No. Only players with Assistants in the auction rows have an offer and can receive a Work. A tie on total offers goes to the player with the higher offer in the third column (then the second, then the first), and each player can take only one Work.
