Can I take a tile that gives a Scotsman when I have none left in my supply?
Two forum replies agree and the rulebook only treats costs as blocking.

Yes. Only the tile's cost is mandatory, so you just don't receive the Scotsman. Running out of Scotsmen never blocks taking a tile.
